This legal agreement is made between user (“You”) and USPS-CD ("Agreement"). This Agreement applies to site that is offering the Service. Please read this Agreement carefully before use the Service. You agree to be bound by the terms and conditions of this Agreement for as long as You continue using the Service. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS OF THIS AGREEMENT, PLEASE DO NOT USE THE SERVICE. THE TERMS AND CONDITIONS OF THIS AGREEMENT ARE SUBJECT TO CHANGES MADE BY US, AT ANY TIME, EFFECTIVE UPON NOTICE TO YOU, WHICH NOTICE SHALL BE DEEMED TO HAVE BEEN PROVIDED UPON OUR POSTING OF THE CURRENT VERSION OF THIS AGREEEMENT ON THE SERVICE.
In this Agreement the following words have the following meanings unless the context requires otherwise:
"Agreement" means the agreement between You and USPS-CD incorporating these terms and conditions for the provision of the Service, as amended from time to time in accordance with the terms and conditions set forth herein;
“We, Us, Our" means United States Postage Stamps – Custom Design, Inc; and
"You, Your, Yourself, User" means the person who use the Service, accepts the terms and conditions of this Agreement and whose order for the Service is accepted by Us.

Eligibility:
By becoming a registered user, You represent and warrant that You are at least 18 years old. If you, your parent, or guardian has any concerns please feel free to contact us. By using this Web site, You represent and warrant that You have the right, authority and capacity to use Our services and to abide by the present terms and conditions. Your membership for the Service is for Your sole, personal use. You may not authorize others to use Your membership and You may not assign or otherwise transfer Your account to any other person or entity.
Registration:
To become a registered user during the ordering process, You must register for the Service and agree to provide accurate, current and complete address information for a proper delivery of ordered material without delay and to maintain and update this information to keep it accurate, current and complete. You acknowledge that if Your delivery address information is untrue, inaccurate, not current or incomplete in any respect, We reserve the right to terminate the Service and, in such an event, You shall not be entitled to a refund.
Term and termination:
If we determine, in our sole discretion, that the user has violated the present Term and Conditions or our posted Privacy Policy, We may discontinue the service for this user.
Proprietary rights:
You represent and warrant to USPS-CD that the text, photographs, pictures or digital images are uploaded or by sent by You to Us are Your exclusive property and You are the exclusive author or the exclusive owner of such material. You will not copy, modify, publish, transmit, distribute, perform, display, or sell any proprietary information.
All users are fully responsible for the photos and images they submit to USPS-CD. Users that submit professional or other copyrighted photos are responsible for obtaining written permission from the studio, photographer or copyright holder. Users that submit photos or images including persons other than themselves are responsible for obtaining permission from those persons. USPS-CD may not be held responsible for the content of any image, photo, or text provided by users of the site.
Users may not use language that is inappropriate, abusive, vulgar, threatening, discourteous, or criminal when entering information. Users may not provide information or materials including text or images that would violate the rights of any third party or which contains a virus or other harmful component. Users may not provide images or photos that are offensive, inappropriate, or illegal. We reserves the right to remove or edit any text or material submitted by users. We reserve the right to refuse processing of any photos, text, or images that may be undesirable or does not comply with the terms of this document.
Pricing, Products and Policies:
You agreed to follow retail and wholesale policies and pay Us for the service and shipping according to Our price list and posted on Our Website. We reserve the right, at any time, to change any fees or charges without prior notice.
All users acknowledge that the finished product provided by Us depends on the quality of the materials and information submitted, and that variations in color, image quality and position may occur. We may professionally edit materials submitted in order to improve the quality of the finished product. We are not responsible for the changes made in the finished product during this editing process.
We will make all attempts to process Your orders as soon as possible. You are responsible for submitting orders with enough time prior to the expected date of receiving the finished product in order to compensate for possible delays.
Indemnity by user:
You will defend, indemnify, and hold USPS-CD and Our officers, directors, employees, agents and third parties harmless, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of user’s use of the Service, including:
(I) Your breach of this Terms and Conditions; (II) any allegation that any materials that user submit to Us or transmit to the Service infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party; and/or (III) Your activities in connection with the Service. This indemnity shall be applicable without regard to the negligence of any party, including any indemnified person.
Intellectual Property:
All intellectual property rights in and to the Service are and shall be owned by Us, absolutely. Those rights include, but are not limited to, database rights, copyright, design rights (whether registered or unregistered), trademarks (whether registered or unregistered) and other similar rights, wherever existing in the world, together with the right to apply for protection of the same. All other trademarks, logos, service marks, company or product names set forth in Service are the property of their respective owners.
